Health and safety legislation is one of many pieces of law that some business owners, particularly those of small and medium sized companies, see as an excessive burden on their business.  However, the Health and Safety at Work Act etc 1974 is the law, just like the Road Traffic Act, Licensing Act, Financial Services Act and hundreds of others.  The penalties for getting it wrong are severe; magistrates can now award fines up to £20,000, while unlimited fines and / or imprisonment up to 2 years can be awarded by the Crown Court.
